Monthly Credit Card Authorization

  1. Monthly Credit Card Charge Authorization and Cancellation

    Automatic Monthly Renewal by Credit Card or Check Card Payment: By entering your bank account or credit card information (“Credit Card”), you are stating that you are an authorized user of the Credit Card and that the associated information entered (account holder name, financial institution, billing address, etc.) is accurate. You also authorize AppFirst to, upon notification by you or your financial institution, modify and/or update the account numbers, expiration dates, or other pertinent information associated with the Credit Card as necessary to complete any authorized transaction. At the time you pay the applicable initial license fee (plus applicable taxes) for the license, you are agreeing and directing AppFirst or its agent to automatically renew your license each month for the applicable license fee (plus taxes) by charging your Credit Card until your license is canceled as provided herein. You agree to pay the applicable monthly license fees (plus applicable taxes) in accordance with your Credit Card issuer agreement.
  2. Monthly Charge Authorization

    When you accept the license agreement for the Software and enter your Credit Card information, you agree that as a condition of your continued license you authorize AppFirst or its agent to charge the applicable monthly license fee (plus applicable taxes) to the Credit Card on the first day of each month for the prior month’s usage, for each consecutive month, until your license is canceled. This continuing charge authorization shall be equivalent to individual signatures by the licensee on subsequent monthly Credit Card charges or "signature on file" transactions. You will not be provided with copies of charge slips evidencing the recurring charges of the applicable monthly license fee. You also agree that the amount of applicable taxes may change from time to time, and you authorize any such changed amount to be included in your recurring monthly charge for your license fee. The initial monthly license fee will be for the initial period starting on the date the license is purchased and continuing through the last day of the month. For example, if on June 18 you purchased your license, your initial license fee will be based on use of the Software until June 30 and your Credit Card will be charged on July 1 for the 13 days you used the Software in June.
  3. Disclosure to and Electronic Fund Transfer Authorization by Check Card Holders

    Check cards are a form of debit card which cause charges against bank accounts and are subject to federal law. If the Credit Card you have provided is a check card, in order to request AppFirst to extend your license month to month you must authorize AppFirst or its agent to charge the check card monthly and therefore to effect preauthorized transfers from the bank account that is associated with your check card. Your request to pay your recurring monthly license fee (plus applicable taxes) with preauthorized charges to your check card and your written or electronic execution of an acknowledgement of your receipt of these terms and conditions constitutes your preauthorized electronic fund transfer authorization for future charges on your check card and your assent to these terms and conditions. You may cancel your license at any time. This cancellation will cancel any check card charge authorization that was to occur on any day after the date of cancellation. After cancellation, you will be charged only for the previous month’s usage on the first day of the preceding month. You may also cancel your preauthorized charge authorization by contacting your bank within a sufficient time to cancel the authorization (see your agreement with your bank for the terms and conditions of cancellation), but cancellation of your authorization with your bank will not serve as notice to AppFirst concerning cancellation of your license.
  4. Expiration of Credit Card or Other Refusal of Charges

    If the Credit Card is no longer valid, has expired, or for any reason will not accept charges for subsequent monthly license fees, you have a period of 10 days from the date that your Credit Card was declined to provide new valid Credit Card information. You agree not to hold AppFirst responsible for any overdraft charges or fees which you may incur during the license term. If new valid Credit Card information is provided within the 10-day period and any past due license fees are paid, then your license will continue uninterrupted and this new Credit Card will be used to charge the applicable monthly license fee for each consecutive month until your license is canceled. If you do not provide new valid Credit Card information within the 10-day period, then your license will expire on either the 11th day from the date your Credit Card was declined.
  5. Cancellation by You

    You can cancel your license at any time and you will only be charged for the number of days you used the Software in the previous month. You agree that the license does not involve an extension of credit or a retail installment sale since you may cancel your license at any time.
